Description

FUNCTIONAL EXPERTISE

  • Partner with members of the Workforce Compliance team assisting with the Department of Transportation Federal Motor Carrier Safety Administration (FMCSA) regulations including confirming of Commercial Motor Vehicle driver credentials. Assembling and maintaining Driver Qualification Files partnering with drivers and supervisors confirming compliant driving records and credentials across multiple states and company locations.

  • Partner with members of the Workforce Compliance team assisting with the Department of Transportation programs involving Pipeline and Hazardous Materials Safety Administration (PHMSA) safety sensitive employees. Partner with PHMSA company contactors across the enterprise ensuring DOT compliance.

  • Meet the drug testing requirements outlined by DOT-FMCSA and DOT-PHMSA regulations and ensuring the Southern Company Gas pools are tested in accordance with DOT regulations. Track drug and alcohol compliance information to ensure the Company meets federally established minimum testing guidelines annually.

  • Assist the Manager, Program Compliance in preparing information used in Public Service Commission audits, internal audits, and departmental audits.

  • Serve as DER, Assistant supporting Manager, Program Compliance in preparing information with expectations issuing authorizations to remove safety sensitive employees from the workplace in the event of a failed drug or alcohol test. Coordinates communications between Legal, Human Resources, Labor Relations and Operations to successfully address failed drug tests timely. Facilitate the Substance Abuse Professional communications as appropriate.

  • Under the leadership of the Manager, Program Compliance, confirm and maintain an active qualified list of drug testing collection sites across all Southern Company Gas locations. Confirm compliance with DOT regulations and perform just-in-time audits as directed.

  • Provide counsel, training programs and communications to Human Resources management, managers, and leadership for DOT FMCSA and PHMSA awareness on issues arising from compliance and regulations, for consistent program administration.

  • Provide input to Human Resources to ensure compliance with local business needs associated with Workforce Compliance including drug and alcohol program awareness, background check requirements and authorizations.

  • Assist with efforts to prepare the Company's Affirmative Action Programs. Perform duties as assigned to prepare data and information for preparation of Affirmative Action Plans and accurate and timely filing of the Company's VETS4212 and EEO-1 reports across company locations on an annual basis.

  • Maintain awareness and understanding of compliance requirements for Workforce Compliance programs with Health and Human Services, Department of Homeland Security, Department of Labor, NHTSA, Office of Drug and Alcohol Program Compliance. ODAPC, Office of Federal Contractor Compliance Programs, OFCCP.

  • Monitor and maintain required labor law and company notices across the enterprise. Serve as the liaison with the company's external vendor responsible for timely updates. Certify compliance annually.

  • Partner with Environmental Health and Safety (EHS) assisting with OSHA compliant processes for hearing conservation and respiratory protection.

BUSINESS ACUMEN:

  • Develop an understanding of the business to partner with multiple constituencies across the enterprise to deliver solid workforce compliance solutions.

  • Possess awareness of business drivers to recognize issues that may be tied to new regulations, revised or enhance policies, regulatory agency audits or internal audit inquiries both internal and external.

  • Collaborate internally with Human Resources; HR Technology; Legal; Supply Chain; Fleet; Ethics and Compliance; Talent Acquisition; Labor Relations; EHS; Accounting; Internal Audit; Operations; Technical Training; Diversity & Inclusion; Regulatory Affairs; Leave Management; Insurance/Risk, Workforce Assessment; Other Operating Companies part of Southern Company.

  • Collaborate with external vendors including Third Party Administrator (TPA) for drug and alcohol testing and background checks, Affirmative Action Plan (AAP) vendor, Medical Review Officer (MRO), Substance Abuse Professionals (SAP), Compliance vendors.

  • Collaborate with all employees including leadership on matters related to Workforce Compliance policies and responsibilities building trust between the department and the business

DRIVING RESULTS:

  • Need to drive outcomes to make sure the workforce is working successfully, and employees are engaged in their role delivering good service for customers.

  • Must regularly meet and collaborate to engage teammates and vendors to complete projects on time, within budget and within the expectations established at the onset.

  • Gather complete data to help the Workforce Compliance Department make decisions leading to good outcomes for the company

    Education, Certifications / Licenses:

Required

  • BA/BS in Business, Human Resources or related field

Preferred:

  • Certification in an HR discipline, e.g., PHR or SHRM-CP or additional certifications obtained in support of Drug and Alcohol Program Administration, e.g., C-DER (DATIA)

Related Work Experience

Required

  • 3-5 years of Human Resources experience in a generalist or specialist capacity would be highly desirable.

Preferred:

  • Experience in Drug and Alcohol Program Administration, Department of Transportation program administration or other compliance related activities tied to a highly regulated multi-state or multiple work location organization.

  • Mathematical and analytical proficiency

  • Good critical thinking skills

  • Attention to detail and consistency in organizational excellence for compliance within government databases and company recordkeeping.

  • Demonstrate an ability to prepare written and electronic reports in a clear and concise manner

  • Good management capacity include relationship building capability to help achieve department objectives

  • Motivated, with good communication both oral and written and interpersonal skills

  • Ability to successfully implement time management skills with competing priorities

  • Ability to interact effectively with others (external vendor relationships and internal manager and employee interactions)

  • Possess computer skills intermediate to advanced (i.e., Word, Excel, MS Outlook, Microsoft Teams)

  • Comfort level with Microsoft Office Technology including FLOW and Forms

Preferred:

  • Possess a strong working knowledge of (DOT, DOL, USCIS, DHS, FTC - FCRA) programs as they impact a workforce

  • Working Conditions/Physical Requirements

  • Office environment, travel requirements should be infrequent (0-10%)
